High Court Writ Seeks Prior Marriage Info in Marriage Registrations

A writ petition has been officially submitted to the High Court in Dhaka, Bangladesh, requesting mandatory inclusion of information regarding prior marriages and children in marriage certificates, known locally as kabinnama. The legal move is specifically designed to combat and prevent information concealment and fraudulent activities during marriage proceedings across the country.

Supreme Court lawyer Ishrat Hasan filed this significant public-interest writ petition on Tuesday, August 25, through the relevant branch of the High Court. The petition calls upon the judicial and legislative authorities to implement crucial structural changes to the standard marriage registration documentation to ensure complete transparency for both brides and grooms entering into matrimony.

Elaborating on the motivation behind the legal action, petitioner and Supreme Court lawyer Ishrat Hasan stated, "The use of incomplete and unequal marriage certificates is causing damage in family life. This is inconsistent with the rights to legal remedy, dignity, and personal security." Her remarks highlight the pressing necessity to reform current administrative practices to better protect individuals from deception.

Several key government bodies and administrative offices have been officially named as respondents in the newly filed writ petition. The specified respondents include the Secretary of the Law and Justice Division, the Secretary of the Legislative and Parliamentary Affairs Division, and the Director General of the Department of Registration.

As the legal proceedings move forward at the High Court in Dhaka, the concerned government departments and administrative divisions are expected to review the directives sought by the petitioner.
