Contradictory Reports Emerge in 1971 War Crimes Case at International Crimes Tribunal
Contradictory findings have surfaced in the 1971 war crimes case involving Tofazzal Hossain alias Taju and others in Dhaka. The International Crimes Tribunal is reviewing the matter following shifting investigation reports and a political transition.
Legal proceedings concerning 1971 war crimes in Dhaka have entered a complex phase at the International Crimes Tribunal-1, highlighted by stark contradictions between initial and subsequent investigation reports. The case involves multiple individuals, including Tofazzal Hossain alias Taju, Mo. Yusuf, and Nur Mohammad alias M. Nur Ahmed, who face allegations related to crimes against humanity committed during the 1971 war. The formal inquiry into these allegations commenced years ago on January 26, 2017, setting off a lengthy investigative and judicial process monitored by the Chief Prosecutor's Office and reported by outlets such as Dhaka Post.
The investigative phase initially produced a 91-page report submitted on May 30, 2019, by investigation officer Mohammad Aminur Rashid. Based on this 2019 filing, the judicial process advanced to subsequent stages, including an initial date fixed for framing charges on December 21, 2022. Following further legal steps, formal charges were officially framed against the accused months later on May 16, 2024. These developments formed the backbone of the prosecution's case before the International Crimes Tribunal.
However, the evidentiary foundation shifted significantly when the tribunal ordered a re-investigation led by Deputy Director Motiur Rahman. This renewed inquiry culminated in a re-investigation report submitted on August 22, 2023, which concluded that initial truths regarding the allegations were not substantiated. Despite this lack of primary verification, an application to frame charges was submitted on December 10, 2023, keeping the judicial machinery active as lawyers and officials navigated the contradictory findings of the two separate investigative files.
The landscape of the case shifted further following the political changeover that occurred in the country on August 5, 2024. In the wake of this political transition, accused individual Tofazzal Hossain surrendered to the authorities and secured bail, subsequently filing a review application challenging the order that had formally framed charges against him. Barrister Ragib Rauf Chowdhury raised specific contentions during the legal arguments, characterizing certain aspects as strictly business related ("শুধুমাত্র ব্যবসায়িক").
By August 19, 2024, the case appeared prominently on the cause list of International Crimes Tribunal-1 in Dhaka, drawing attention to the procedural anomalies and conflicting reports compiled by investigators like Mohammad Aminur Rashid and Motiur Rahman. As the tribunal deliberates on the path forward, the next date for issuing orders has been formally scheduled for August 31, 2024. This upcoming session is expected to address the unresolved contradictions and the ongoing review applications filed by the defense.
